What is Fair Use

Fair Use is not determined by Youtube. Every country has different laws against fair use, you may not realize because they may call it something other then Fair Use.

But just because you say something is fair use doesn't mean it always is because just by crediting the owner or saying it is not meant to offend anyone does not protect you.

Someone saying something is Fair Use doesn't mean it always is as just crediting the owner of the origenal or saying something is not made to offend anyone doesn't protect you. 

If you merely copy another or try to monetize your product does not mean it qualify for Fair Use. A perfect example which is extremely common to find on streaming platforms such as Twitch or Youtube is that only a few seconds of a song or something playing in the background which is not the creators fault means that they can have their video or stream claimed by the product owner. Decisions could be taken lightly but none the less but are they?

So where does Youtube fall into all this?

Youtube is the largest online video sharing and social media platform which has been running since February 14th 2005. With this in mind they made $28.8 Billion USD.

With that information, Youtube has implemented a system which shows you what aspects of you video can be claimed by other creators or companies so you know what you can and can't use to keep your monetization going. They do this by showing you the part and timestamp of your video which could be claimed and giving you some suggestions of what you can change it out for. With Youtube helping you avoid videos being claimed by others, they also need to enforce fair use and copyright. They have 2 methods of them enforcing:

- Video being "Copyright Claimed" Which means all profit goes the the artist

- Video being "Copyright Striked" which is similar the being claimed by you also get a warning on record.

Youtube uses methods to stop people from using too much of someone else's content. This is because Youtube have a strike system in place which is:

- 1st Strike: Blocked from uploading (videos or stories), going live, custom thumbnails and making community posts for 1 week.

- 2nd Strike: Blocked from uploading (videos or stories), going live, custom thumbnails and making community posts for 2 week.

- 3rd Strike: Youtube channel and account will be terminated, all videos removed and denied access to create any new channels in the future.

Don't stress too much though as you can get your strikes removed!

Youtube have made methods to lose strikes because then all of your favourite Youtubers would be gone a long time ago. You are able to Retract a claim or copyright infringement if it was a mistake, submitting a counter notification or waiting. Strikes have expiration dates in a way which means that losing a strike is as easy as not getting another for 90 days.
